Waco Article Regarding Fifth Circuit Court of Appeals Win
The Fifth Circuit Court of Appeals has reversed a lower court’s decision and ruled that the case involving the death of Kelli Leanne Page, a 46-year-old woman who died in the Coryell County Jail, may proceed to trial in Waco federal court. Page’s parents, represented by Dean Malone of the Law Offices of Dean Malone, P.C., allege that jailers used excessive force by restraining Page face down with weight on her back and neck, leading to her death by mechanical asphyxia.
The appellate court found sufficient evidence for a jury to determine whether the jailers’ actions violated Page’s constitutional rights, underscoring ongoing concerns about the treatment of individuals in custody and the use of force in Texas jails.
