A 2022 Jim Hogg County Jail Death Goes Unreported-Pt.5

Little has been made known about the 2022 death of Michael Tokos possibly at Jim Hogg County Jail, which is in Hebbronville, Texas. Mr. Tokos had been an inmate there and has passed away, but a custodial death report (CDR) has not been filed. City and county jails in Texas have 30 days to file a CDR after an inmate has died in jail custody. After 30 days, the filing is late.

Rule §265.13(a)(c)

In a jail inspection report dated October 16, 2018, TCJS cited Jim Hogg County Jail for six alleged violations of minimum jail standards. Further details follow regarding noncompliance with Rule §265.13(a)(c), which is under a chapter on General Sanitation.

Under part (a), the veteran status of each inmate must be verified using data that can be accessed from the Veterans Reentry Search Service (VRSS).  In addition, in part (c), sheriffs must maintain a log of positive VRSS returns. Identifying inmate numbers must be included along with information such as whether a referral card was issued.

  • During the jail inspection, inspectors attempted to review the VRSS Logs. However, it was discovered that the staff is neither reporting inmates through the VRSS system nor maintaining a VRSS log, which are procedures required in minimum jail standards.
