Any Texas Jail Detainee Could Become a Victim of Sexual Assault-Pt.5
It was decided that the Commission appointed to see to matters concerning the Prison Rape Elimination Act should recommend national standards to detect, prevent, reduce, and punish jail rape. The following matters will be included:
- Classify and assign inmates with the use of standardized protocols and instruments in a way that limits jail rape incidents.
- Rape complaints will be investigated and resolved by authorities with the police, Federal, and State agencies.
- Testimonial and physical evidence shall be preserved for use in the investigation of circumstances related to the sexual assault.
- Acute-term trauma care for sexual assault victims that includes standards specifically related to:
- The extent and manner in which any psychological treatments, psychiatric care, mental health counseling, and medication are to be provided to any victim of sexual assault; and
- The extent and manner in which a physical exam and treatment will be provided to a victim.
- Referrals will be made for rape victims’ long-term continuity of care.
- Medical testing procedures to reduce the incidence of transmission of sexual diseases.
- Correctional staff will be trained sufficiently to ensure that they comprehend and appreciate the seriousness of jail rape and why it must be eliminated.
- Ensuring the confidentiality of jail rape complaints and protecting inmates who make complaints of jail rape.
