On September 24, 2025, Gary Forrest Jarvis, 68, was booked into Comal County Jail. Sadly, Mr. Jarvis died in the jail’s custody on February 10, 2026. The Comal County Sheriff’s Office (CCSO) filed a custodial death report (CDR) about Mr. Jarvis’s death on February 11, 2026.

According to the report, during intake, Mr. Jarvis appeared to have a medical issue. In addition, the report reflects that he received treatment for the medical condition that caused his death after he arrived at the Comal County Jail. According to the CDR’s summary of how Mr. Jarvis’s death occurred, he was taken by ambulance to Christus Santa Rosa Hospital at 1:27 a.m. on 02/08/2026 due to an obstructed bowel.

While hospital staff were providing medical attention, Mr. Jarvis went into cardiac arrest. Cardiopulmonary resuscitation (CPR) and other lifesaving measures were attempted. Tragically, Gary Jarvis was pronounced deceased by a physician at 5:33 p.m. on February 10, 2026. An autopsy request was submitted to a Justice of the Peace.

When someone dies in custody, families are left with grief, confusion, and urgent questions. Even when a jail provides some level of treatment, the law still requires that detainees receive timely and appropriate medical care. An intestinal obstruction is a serious, potentially life-threatening condition, and delays in diagnosis or transport can quickly become fatal.

The Comal County Jail is at 3000 IH 35 South, New Braunfels, TX 78130. The jail currently has a capacity of 582 inmates.

Understanding Fatal Bowel Obstruction in a Jail Setting

A bowel obstruction can cut off blood flow, cause infection, and lead to sepsis or organ failure. Symptoms are frequently obvious: severe abdominal pain, swelling, vomiting, inability to pass stool, and visible distress.

Correctional staff are required to respond reasonably when a person in their custody shows clear signs of a medical emergency. Critical steps to avoid the mismanagement of bowel disease include monitoring, documentation, and rapid transfer to a hospital. If those steps are delayed, minimized, or handled improperly, the outcome can turn tragic.

Treatment Before Transport: Is It Enough?

Families sometimes hear that jail personnel “treated” the individual before sending them to an outside medical facility. That statement alone does not answer the key legal question. What matters is whether the response was adequate and timely, given the seriousness of the symptoms. For example, answers to the following questions are often sought:

  • How long the detainee complained of pain
  • What observations were recorded
  • When medical staff were notified
  • Whether worsening symptoms were recognized
  • Why and when transport occurred
  • If outside emergency care should have happened sooner

A brief delay or denial of medical care can be the difference between survival and death.

Families Seeking Accountability After a Suspected Jail Negligence Death

If someone you love died while in custody and you suspect the loss may be connected to medical neglect, dangerous conditions, or failure by staff to respond, the Law Offices of Dean Malone, P.C. might be able to assist. Our practice centers on in-custody death matters, including situations involving postponed or refused treatment, suicide concerns, and broader breakdowns in jail systems. We work to carefully examine what occurred, determine whether constitutional rights were violated, and seek accountability from those involved.

Timely investigations are important for determining whether applicable standards were followed and whether alternative decisions could have affected the outcome. Although litigation cannot reverse a tragic death, it can provide answers, promote accountability, and, in some cases, encourage reforms that safeguard others.

Families should not feel compelled to navigate this process alone. When custodial deaths occur and it is suspected that jail neglect may have been the cause, our team at the Law Offices of Dean Malone, P.C., is dedicated to finding out what happened and why.
