Erath County Jail Fails State Inspection Re Strip Searches

On December 19, 2025, the Erath County Jail was subjected to a special jail inspection by a Texas Commission on Jail Standards (TCJS) inspector. A notice was sent to the Erath County Sheriff’s Office on March 11, 2026, regarding one alleged violation of minimum jail standards. TCJS has also listed the Erath County Jail on its site, along with other jails found to be noncompliant.

Rule §265.2(b) pertains to the search of inmates during admission. This rule requires that when staff determines a strip search is necessary to locate weapons or contraband that could threaten facility safety, the search must be conducted by personnel of the same gender as the inmate, and carried out in a reasonable, private, and dignified manner. The following was conveyed by the inspector in the jail inspection report:

  • It was self-reported by the Erath County Jail that a female prisoner was strip-searched twice by male staff on February 24, 2026.

Are There Legal Implications When a Female Inmate is Strip-Searched Twice by Male Staff?

In Texas jails, strip searches are subject to strict constitutional and policy limits because they involve a highly intrusive invasion of personal privacy. While facilities may conduct strip searches for legitimate security purposes, courts have long recognized that such searches must be carried out in a reasonable manner, with particular sensitivity to dignity and privacy concerns. In addition, these actions may expose a county or municipality to civil liability under federal civil rights law if they demonstrate deliberate indifference or a failure to properly train and supervise staff.
