The Texas Commission on Jail Standards (TCJS) currently lists Liberty County Jail in Texas as a Non-Compliant Jail on the TCJS website. A Notice of Non-Compliance was issued on August 7, 2023. Rule §273.4(b)-Health Records
Liberty County Jail was found to be non-compliant with the following rule in the chapter on Health Services. Rule §273.4(b)-Health Records states: Separate health records shall reflect all subsequent findings, diagnoses, treatment, disposition, special housing assignments, medical isolation, distribution of medications, and the name of any institution to which the inmate’s health record has been released.
- During the review of documentation for custodial death which occurred September 30, 2021, only the August 2021 Medication Administration Record was provided, even though the inmate had been prescribed medications since July 14, 2021. During the review of documentation of a custodial death that occurred on November 26, 2022, medication was started for the inmate but there is no documentation of who prescribed it.
Rule §273.5(C)(1)- Mental Health/Intellectual and Developmental Disabilities History Check
Liberty County Jail has been cited for violating Rule §273.5(C)(1)-Mental Health/Intellectual and Developmental Disabilities History Check, which is also in the chapter on Health Services. Each jail shall: Check each inmate upon intake into the jail against the Texas Health and Human Services Commission CCQ system to determine if the inmate has previously received state mental healthcare or has a known intellectual or developmental disability.
- During the review of documentation for a custodial death that occurred on September 30, 2021, it was determined the Continuity of Care Query (CCQ) was run almost 9 hours after intake. During the review of documentation for a custodial death that occurred on May 10, 2023, it was determined the Continuity of Care Query (CCQ) was run almost 48 hours after intake.
