Non-compliance with minimum jail standards results in heightened monitoring.

Restraints

The purpose of minimum jail standards is generally to ensure the safety of inmates, jail staff, and the public. Although inmates’ constitutional rights are not surrendered by virtue of being incarcerated, they can still be restrained in specified circumstances. TCJS provides standards regarding the use of restraints, from handcuffs to perhaps the most restrictive type of restraint, which is a restraint chair. The following are among the rules guiding restraints in Texas jails:

  • A medical professional or member of the supervisory staff at the jail must make the decision to use restraints.
  • The medical condition of an inmate must be assessed by appropriate personnel before the individual is placed in restraints.
  • The type of restriction of movement needed should dictate the type of restraint used. An inmate should be restrained only to the necessary degree to prevent behavior that is injurious to the inmate or others.
  • If an inmate has any physical infirmities, they must not be restrained in a manner that would worsen their physical condition.
