Restraints

As is the case in all Texas jails, Montgomery County Jail staff can use restraints on inmates according to TCJS guidelines. Medical care of prisoners is a major concern with regard to the use of restraints, as evidenced by the standards for using them being placed in the Texas Administrative Code section on health services. Some of the guidelines for using restraints in Texas jails follow:

  • When inmates behave in a manner that endangers themselves or others, restraints can be used to manage them and mitigate the threat of injury. At all times, restraints must be used humanely. Restraints can never be used as a form of punishment.
  • Only designated individuals can make the decision to place prisoners in restraints, those being medical personnel and supervisory staff.
  • The medical condition of an inmate should be evaluated by a qualified member of the staff before placing him or her in restraints.
  • The type of restraint used on an inmate should restrict movement only to the degree necessary to prevent harm.
  • If an inmate has a physical infirmity, they must not be placed in a restraint or in a position that worsens the inmate’s condition.
