Man Shot and Killed After Chase by Corpus Christi, Texas Police Officer

A custodial death report filed with the Texas State Attorney General by the Corpus Christi Police Department details the unfortunate death of Dewboy Lister, apparently 55 years of age at the time of his death.  Mr. Lister passed away on or about October 20, 2017.  Information contained in this post was obtained from that custodial death report.  Therefore, our firm has no personal knowledge of what actually occurred.  Moreover, we do not by making this post indicate that anyone did anything wrong and/or acted inappropriately.

According to the report, an officer conducted a traffic stop of Mr. Lister.  Allegedly, during the traffic stop, a brief physical altercation occurred.  Mr. Lister then allegedly fled in his vehicle.  Ultimately, after pursuit of Mr. Lister by the police officer, Mr. Lister abandoned his vehicle.  The officer followed on foot, and Mr. Lister allegedly at some point decided to fight the police officer.  Mr. Lister allegedly was able to get on top of the police officer with his arms wrapped around him.  The officer stated that he believed he was losing the fight and could feel Mr. Lister sliding his arms upward toward his neck.  The police officer allegedly feared for his life, drew his pistol, and shot Mr. Lister one time in the chest.

A Corpus Christi, Texas, Police Officer Allegedly Shot and Killed a Man After a Traffic Stop

On Thursday evening, October 19, 2017, a 55-year-old man was pulled over in traffic by a Corpus Christi police officer. The motorist had allegedly been taking up two lanes while driving. According to authorities, the man admitted to the officer that he had been arrested previously. The officer attempted to place the man in the back of his patrol car when a struggle ensued. The suspect ran back to his vehicle and sped away. Later, law enforcement officers caught up with him, and he began running on foot. Another struggle ensued, during which the suspect was allegedly shot by a police officer. The injured man was taken to the hospital and was in surgery for approximately 3 hours. He died early the next day.

The police officer who allegedly shot the man has been with the Corpus Christi Police Department for 16 months, authorities said. He has been placed on administrative leave while an investigation is conducted.

Mike Markle, Corpus Christi Police Chief, released video footage from a body camera worn by a police officer, and it shows that the suspect was pulled over by an officer for driving on two lanes of traffic. There was no mention of a video that may have captured the alleged police shooting.

When police officers use excessive force, they can be held accountable. This ongoing investigation will examine whether proper police procedures were followed. Police officers can be disciplined, fired, and charged with a crime, when there is evidence to suggest that he or she failed to use proper procedures, particularly when an incident involves someone being injured or killed.
