A Dallas Walmart Worker Suffers an Amputation Injury-Pt.3
Kroger was cited for alleged safety violations following a November 2021 inspection that was instigated by a Texas work accident in which a worker suffered serious workplace injuries. Kroger, Amazon, Home Depot, Lowe’s, and Walmart are all duty-bound to provide safe work environments for employees, though none are likely subscribers to the workers’ comp program in Texas.
The Department of Labor’s Occupational Safety and Health Administration (OSHA) cited the Houston Kroger on Gellhorn for three alleged safety violations. Details follow.

The alleged serious violation of standard 19100178 A04 about powered industrial trucks such as forklifts specifies that additions and modifications cannot be performed by the user or customer without the prior written approval of the manufacturer if either capacity or safe operation is affected. Changes to operation, capacity, and maintenance instruction decals, tags, or plates must be made accordingly. The initial and current penalty amount for this violation is $14,502.

The alleged serious violation of standard 19100178 L01 II requires employers to make sure each forklift or other powered industrial truck operator has successfully completed the training requirements prior to allowing an employee to operate a powered industrial truck, other than for purposes of training. The initial and current penalty amount for this violation is $14,502.
