A Forklift Operator is Killed in a Fatal Texas Work Accident-Pt3

A fatal forklift accident occurred in Waco, Texas, on December 16, 2020. Forklift accidents are continuous threats at such places as Walmart, Home Depot, Lowe’s, and Amazon. These big box stores are not likely subscribed to the Texas program of workers’ compensation.

Continuing with this series, the following are more of the citations issued by the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) following the December 2020 fatal forklift accident in Texas.

Standard Cited:19100178 Q01 Powered industrial trucks.

This safety standard mandates that any forklift or other type of power-operated industrial truck that is not in safe operating condition must be removed from service. Only authorized individuals are permitted to make repairs on such vehicles. The initial penalty proposed by OSHA for this alleged violation was $5,266, and it is also the current amount due.

Before any forklift or other type of industrial truck is placed in service, it must be examined. If the examination shows that any state of the vehicle adversely affects its safety, it must not be placed in or returned to service. These thorough vehicle checks must be made at least daily. In instances where industrial trucks are used around the clock, they must be examined after each shift. Anytime a defect is discovered, it must be immediately reported and corrected.
