Yet another worker died last week as a result of a trench collapse. There is absolutely no excuse for an employer not following OSHA regulations regarding trenching and protecting employees. Texas employers must comply with OSHA regulations, and if they fail to do so and further fail to obtain worker’s compensation coverage, they can be sued or have claims asserted against them in arbitration when workers are injured. Death from a trench collapse in Texas is completely avoidable, and Texas employers have duties to provide safe workplaces to their employees.
