Clay County Jail is Cited for Allegedly Mishandling Prescription Medication
Clay County Jail in Henrietta, Texas, has been added to the list of non-compliant jails on the Texas Commission on Jail Standards (TCJS) website. While conducting a special jail inspection of Clay County Jail, TCJS inspectors discovered that the jail had violated one minimum jail standard. The inspectors’ note conveys the following:
- During a complaint review at Clay County Jail, inspectors determined that prescription medication was not reviewed as soon as possible after an inmate was taken into custody.
This is not the first time that Clay County Jail dropped the ball as regards following the medical instructions of designated physicians. The inspector’s note from an August 10, 2023, jail inspection provides disturbing details:
- The provider ran out of medication ordered by a designated physician, but there was no back-up pharmacy to provide the required medications. The missed medication error rate is that out of 300 entries, there were 76 errors equaling a 25.3 percent compliance rate for medication not distributed.
Any time there is a breach in minimum jail standards, there is a potential for inmates to suffer some type of harm. It isn’t difficult to imagine what could happen if an inmate is denied necessary drugs. The following occurred in 2023:
- Fifty-four-year-old Dexter Barry was arrested and placed in Duval County Jail in Florida. He was careful to inform the arresting officer and the jail nurse on multiple occasions of the following: He was taking prescription medication so that his body would accept his heart transplant, but without it, he would die. For the two days Mr. Barry was held, he was not allowed access to the medication, though he desperately requested it. Tragically, Dexter Barry died three days after he was released from the jail. He died from cardiac arrest that resulted from an acute rejection of the heart.
